Amica Perks – Events Waiver Agreement

1. In consideration of participating in the fitness classes with Kaitlin Kloss / Zest Wellness AU, I agree and acknowledge that I am fully aware that participation in the activities involved have risks and I accept all the risks of participating, even if the risks are created by the carelessness, negligence or gross negligence of a Released Party (as defined below) or anyone else.
   
   
2. This includes but is not limited to any and all liabilities, claims, demands, legal actions, rights of actions for damages, personal injury or death in connection with participation in the Activity. “Released Party” means fitness with Kaitlin Kloss / Zest Wellness AU and any of their instructors, teachers, staff and subcontractors or any of its affiliates, franchisees and their respective representatives, directors, officers, agents, employees or volunteer staff.
   
   
3. I agree and acknowledge that:
   1. I am in proper physical condition to participate in the Activity, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death.
   2. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured.
   3. I am aware that if the Activity occurs outdoors, the streets adjourning the area of the Activity are open to regular vehicular traffic during the Activity and I will obey all traffic laws and regulations.
   4. I accept full responsibility for any product or technology loaned to me as part of participation in this Activity and commit to return the same in good working order.
   5. I hereby, for myself and for my heirs, next of kin, executors, administrators and assigns, fully release, waive and forever discharge any and all rights or Claims I may have, now or in the future, against any Released Party, even if the Claims are based on the carelessness, negligence or gross negligence of a Released Party or anyone else. Without limiting the foregoing, I further release any recourse that I may now or hereafter have resulting from any decision of any Released Party.
      
      
4. I agree not to sue any Released Party for Claims, even if the Claims arise from the carelessness, negligence or gross negligence of any Released Party or anyone else. I agree to indemnify (reimburse for any loss) and hold harmless each Released Party from any
   loss or liability (including any reasonable legal fees they may incur) defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the carelessness or negligence of any Released Party or anyone else.
   
   
5. I am aware that there is no obligation for any person to provide me with medical care during the Activity. I understand and acknowledge that:
   1. There may be no aid stations available for the Activity.
   2. If medical care is rendered to me, I consent to that care if I am unable to give my consent for any reason at the time the care is rendered.
      
      
6. I am aware that it is advisable to consult a physician prior to participating in the Activity. If I have consulted a physician, I have taken the physician’s advice.
   
   
7. I grant my permission to the Released Party and any transferee or licensee or any of them, to utilise any photographs, motion pictures, videotapes, recordings and other references or records of the Activity which may depict, record or refer to me for any purpose (“Likeness”), including commercial use by the released parties, their sponsors and their licensees. This permission is for use anywhere in the world and on the Internet and for an unlimited period of time. I understand and agree that I will not be compensated or receive additional consideration for consenting to the use of my Likeness and that I will not be given a chance to receive, inspect or approve the promotional or marketing material, messages and/or content that may use my Likeness.
   
   
8. No warranties or representations have been made to me about the Activity which are not stated on this form. I understand and intend that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnity.
   
   
9. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
   
   
10. I hereby acknowledge that I may be required to use an automobile to travel to and from the Activity or as part of the Activity. I hereby acknowledge that I have the authority to use such automobile and that the automobile is fully insured for use in the Activity. I accept full responsibility for the automobile and that use of the automobile in the Activity will be at my own risk.
    
    
11. I agree to release and hold harmless the Premises Owner, its employees and agents from and against any liability arising out of any injury, loss, damage or death caused to me or my property or any other person arising from or in connection with the Activity whether such injury, loss, damage or death was caused directly or indirectly by negligence, breach of contract or any way whatsoever other than where the injury, loss, damage or death was caused solely by the negligence of the Premises Owner or its employees or agents.
    
    
12. I agree to indemnify and hold harmless the Premises Owner, its employees and agents from all claims, damages, losses, injuries and expenses arising out of or resulting from the Activity. This indemnification extends to all claims made by any other person against the Premises Owner, its employees or agents in respect of any injury, loss or damage arising out of or in connection with my participation in the Activity, other than where the injury, loss, damage or death was caused solely by the negligence of the Premises Owner or its employees or agents.
    
    
13. I agree to comply with all rules and directions made or given by or on behalf of the Premises Owner in connection with the Activity.
    
    
14. I agree to report all accidents, injuries or loss or damage sustained by me to the Premises Owner before I leave the site on which the Activity is performed. I agree that if I suffer any injury or illness the Premises Owner may provide or arrange evacuation, first aid and medical treatment at my expense.
    
    
15. I warrant that I will comply with the requirements of any:

• Public, statutory or other authority which has jurisdiction in respect of the Activity; and
• Acts, regulations, orders and awards that apply to the Activity in the jurisdiction where the Activity is being carried out.

18. I warrant that I have the approval of any:

• Public, statutory or other authority which has jurisdiction in respect of the Activity; and
• Relevant professional body to carry out the Activity (including, without limitation, any required licence).

Amica Perks - Rewards Terms and Conditions

1. Amica Perks - Rewards is open to members of Amica only.
2. Only one claim per person unless otherwise stated.
3. The closing date is as specified in each reward, and Amica reserves the right to amend the reward end date at any time.
4. By claiming the reward, the member agrees to participate in any such promotional activity and material as Amica may require.
5. No part of a reward is exchangeable for cash or any other prize.
6. If an advertised reward is not available, we reserve the right to offer an alternative reward of equal or greater value.
7. Each reward will have clear guidelines and or instructions on how to claim.
8. Distribution and or collection of reward will be coordinated by International Towers team.
9. Amica Perks - Rewards is brought to you by Amica and has no affiliation with, association to, authorisation or endorsement by Apple iOS and Android or any of their subsidiaries.
10. Amica reserves the right to amend these rules at any time. Amica may also create rules which will apply to a specific reward only. If we do this, then we will publish the amended reward rules and/or specific reward rules on the relevant reward page. 
11. In using the 'Amica Perks' app, please note that once you redeem your points, they are no longer available for future use.
12. After the points are redeemed they need to be used in the allocated time otherwise they will be lost.
13. It is important to claim your points within the designated time period and during any ongoing promotional campaigns. Failing to do so will result in the loss of your accumulated points.
14. Amica reward points can be accumulated up to 12 months at a time. The current expiry period for all Amica reward points will be 31 December. Please use your Amica reward points before this time.

Amica Perks - Competition Terms and Conditions

In line with The Community Gaming Act 2018 and the Community Gaming Regulation 2020 started on 1 July 2020, we outline the “rules” of this competition as follows. When you enter one of our competitions, we will assume that you have read these rules and that you agree to them.

1. Competition is open to members of Amica only.
2. Only one entry per person unless otherwise stated.
3. The closing date is as specified in each competition, and Amica reserves the right to amend the competition end date at any time.
4. By entering the competition, the winner agrees to participate in any such promotional activity and material as Amica may require.
5. No part of a prize is exchangeable for cash or any other prize.
6. If an advertised prize is not available, we reserve the right to offer an alternative prize of equal or greater value.
7. Each competition will have clear guidelines and or instructions on how to compete or register to win.
8. Incorrectly completed entries will be disqualified.
